Terms of Use, Service & Privacy Policy

These Terms of Use, Service & Privacy Policy ("Terms") govern the services provided by Metaview Technologies LLC DBA Metaview Real Estate Marketing ("Metaview," "we," "us," or "our"). By scheduling, purchasing, downloading, accessing, or using our services or media, you agree to these Terms.
## 1. Services
Metaview provides real estate marketing media, which may include photography, aerial/drone photography, video, virtual tours, Matterport tours, floor plans, virtual staging, property websites, and related services.
Services are intended for real estate marketing and are not property inspections, appraisals, surveys, engineering reports, measurements, or guarantees regarding a property's condition, size, boundaries, features, or legal compliance.
## 2. Booking, Payment & Additional Charges
Payment is due at the time of booking unless otherwise approved by Metaview in writing.
A booking is not confirmed until payment or written confirmation is received. Any unpaid appointment may be canceled or released to another client.
Additional fees may apply for travel outside our service area, rush delivery, excessive editing, special equipment, difficult access, unusually large properties, return trips, or other services not included in the selected package. Any applicable charges will be communicated when reasonably possible.
## 3. Cancellations, Rescheduling & No-Shows
Cancellations made at least 24 hours before the scheduled appointment are eligible for a full refund.
Cancellations made less than 24 hours before the appointment may be subject to a cancellation fee or may receive a future-service credit at Metaview's discretion.
Same-day cancellations, no-shows, denied access, inaccessible properties, incorrect addresses, or properties that are not ready for the scheduled service may result in forfeiture of payment or an applicable trip fee.
Weather-related rescheduling will not incur a penalty when conditions prevent safe or appropriate capture. Metaview will work with the client to schedule a new appointment at the earliest reasonable availability.
## 4. Client Responsibilities & Property Preparation
The client is responsible for providing the correct property address, access instructions, gate codes, lockbox information, contact information, and any relevant restrictions before the appointment.
The property must be ready for capture at the scheduled time. This includes cleaning, staging, turning on lights, opening blinds where desired, securing pets, removing unwanted items, and ensuring safe access to all requested areas.
Photographers are not responsible for moving furniture, personal belongings, vehicles, pets, hazardous materials, or valuables. Metaview may decline to photograph any area that appears unsafe, inaccessible, illegal to capture, or unsuitable for the requested service.
The client is responsible for obtaining any necessary permission from property owners, tenants, homeowners' associations, building management, neighbors, or other parties before services are performed.
## 5. Delivery Times
Typical delivery times begin after the appointment is completed:
* Photography and floor plans: within 24 business hours.
* Virtual tours and Matterport tours: within 24 business hours.
* Video, reels, and teaser content: typically within 48 business hours.
* Virtual staging, extensive edits, or custom projects: delivery time may vary.
Delivery times are estimates, not guarantees. Delays may occur because of weather, technical issues, editing requirements, high-volume periods, client-requested changes, or circumstances outside Metaview's control.
## 6. Revisions & Client Approval
One reasonable round of standard photo-edit requests may be included when requested within 72 hours of delivery, unless otherwise stated in the selected package.
Additional revisions, major alterations, replacement edits, virtual staging changes, or requests submitted after the revision period may incur additional charges.
Clients are responsible for reviewing delivered media promptly. Use, publication, download, or approval of delivered media constitutes acceptance of the final product.
## 7. Copyright & License for Use
All photographs, videos, drone media, floor plans, virtual tours, Matterport content, virtual staging, property websites, and other media created by Metaview remain the copyrighted property of Metaview Technologies LLC DBA Metaview Real Estate Marketing, unless otherwise agreed in writing.
Metaview grants the purchasing client a limited, non-exclusive, non-transferable license to use the delivered media solely to market the specific property or business for which it was created.
The license is valid only while the purchasing agent or brokerage represents that property.
The license permits normal marketing use, including MLS, brokerage websites, property websites, social media, print marketing, email campaigns, and other promotional materials directly related to that property.
The media may not be sold, sublicensed, transferred, shared, gifted, reused, or provided to another agent, brokerage, homeowner, builder, designer, stager, business, photographer, or third party without Metaview's prior written permission.
The media may not be used to market a different property, relisting, rental, business, product, or service. A new listing agent, homeowner, builder, designer, stager, or other third party must obtain a separate license from Metaview before using the media.
Media may not be materially altered, manipulated, misleadingly edited, or used with artificial intelligence without Metaview's prior written approval. Virtual staging is for visual marketing purposes only and must not misrepresent the actual condition or included features of a property.
Unauthorized use may result in license termination, removal requests, additional licensing fees, and legal action.
## 8. Portfolio & Promotional Use
Unless the client notifies Metaview in writing before the appointment, Metaview may use captured media for its portfolio, website, social media, advertising, awards, educational materials, and other promotional purposes.
Metaview will not intentionally disclose confidential access codes, alarm codes, private client information, or other non-public sensitive information.
## 9. Liability & Limitation of Responsibility
Metaview is not responsible for property conditions, missed listing opportunities, inaccurate property information, market performance, MLS errors, internet outages, third-party platform failures, or how clients or third parties use delivered media.
Metaview is not responsible for damage, injury, loss, or delay caused by unsafe conditions, pets, property occupants, hidden hazards, inaccessible areas, weather, equipment failure, third-party restrictions, or circumstances outside Metaview's reasonable control.
To the maximum extent permitted by law, Metaview's total liability related to a service will not exceed the amount paid by the client for that specific service.
## 10. Privacy Policy
Metaview may collect information needed to provide services, including names, email addresses, phone numbers, billing information, property addresses, booking details, access instructions, service selections, communications, and payment-related information.
We use this information to schedule appointments, process payments, communicate with clients, provide and deliver services, improve our operations, respond to requests, and comply with legal obligations.
We may use trusted service providers, including booking platforms, payment processors, website hosts, cloud-storage providers, email providers, and analytics services, to help operate our business. These providers may process information only as necessary to provide their services.
Metaview does not sell personal information. We do not knowingly collect personal information from children under 13.
We use reasonable measures to protect personal information, but no website, email system, storage system, or internet transmission can be guaranteed completely secure.

## 11. Third-Party Platforms & Links
Our website, booking portal, property websites, virtual tours, payment tools, or communications may include third-party services or links. Metaview is not responsible for the privacy practices, content, availability, or policies of third-party websites or platforms.
## 12. Force Majeure
Metaview is not liable for any delay, failure, cancellation, or inability to perform caused by events outside our reasonable control, including severe weather, natural disasters, government actions, internet or power outages, equipment failure, illness, accidents, transportation disruptions, or emergencies.
## 13. Changes to These Terms
Metaview may update these Terms from time to time. The current version will be posted on our website. Continued use of our services, website, or media after updates are posted constitutes acceptance of the revised Terms.
## 14. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or Metaview's services will be handled in the appropriate courts located in Florida, unless otherwise required by law.
